These general terms and conditions of sale (the “General Conditions”) govern the terms and conditions under which L.G. GEMME DI LACAGNINA GAETANO will provide you with its products (hereinafter the “Products”) for sale online on the website https://lggemme.com (hereinafter the “Site”). These General Conditions apply exclusively to the Products sold by L.G. GEMME through the Site.

 

We urge you to carefully read and understand these General Conditions before placing an order to purchase any Product on the Site. Whenever you intend to place a purchase order, you must declare that you have read, understood and accepted the contents of these General Conditions. If you do not accept these General Conditions, you will not be able to place purchase orders for any Product for sale on the Site. The user is advised to print and keep a copy of this document for future reference.

  1. Description of Products

Gems featured on [LG GEMME](https://lggemme.com) include various types, such as cubic zirconia, sheelites, and emeralds, and are all certified by a gemologist with a certificate of authenticity and, when possible, provenance. The images on the site are original and the exclusive property of L.G. GEMME, and any unauthorized reproduction, dissemination or use is expressly prohibited. Any infringement will be prosecuted according to current copyright regulations. 

Although images are high resolution, slight variations in color and size from the actual product may occur. In addition, descriptions are carefully edited, but may contain errors or minor differences from the physical product. If reported, L.G. GEMME will endeavor to correct any inaccuracies promptly.

 

  1. Prices and Methods of Payment

Product prices are in Euros and include VAT. Shipping costs are calculated separately and are clearly indicated during the checkout process. L.G. GEMME reserves the right to change prices at any time at its discretion. Price changes may result from currency fluctuations, and such changes will be applied at the time of purchase. 

Payments are handled through Shopify's secure platform, which uses advanced encryption protocols to ensure secure transactions. We accept payments through PayPal and credit cards. L.G. GEMME does not retain or store customer payment data.

  1. Availability of Products

In the event that a purchased product is no longer available, L.G. GEMME undertakes to propose an alternative product of similar value and characteristics. If the customer does not wish to accept the proposed alternative, a refund equal to the amount paid will be issued. Orders are generally processed within 2 business days.

  1. Purchase Process

The site uses an electronic shopping cart system that allows customers to select the products they want. Before confirming the order, customers must correctly provide shipping and payment information. L.G. GEMME is not responsible for any shipping errors resulting from incorrectly provided information. Any additional costs caused by customer errors will be borne by the customer. 

Once the order is completed, the customer will receive an email confirmation. Customers may choose to create an account on the site or make the purchase as a guest.

 

  1. Certification and Authenticity

All gems sold by L.G. GEMME are certified by a professional gemologist with an IGI (Italian Gemmological Institute) certificate. At the customer's request, additional certifications can be obtained, the cost of which will be borne by the applicant.

 

  1. Customization Services

L.G. GEMME offers gem cutting and personalization services, which can be purchased separately or arranged directly with the seller. Costs for such services will be additional to the price of the gems and borne by the customer. Lead times and customization methods will be defined on a case-by-case basis according to the customer's needs.

 

  1. Changes and Cancellations of Orders.

Customers may request changes or cancellation of an order by sending an email to info@lggemme.com. Requests must be made before the order is processed by the vendor. L.G. GEMME does not guarantee that changes or cancellation can be made once the order is in the process of being shipped.

  1. Intellectual Property

All content on [LG Gemme](https://lggemme.com), including, but not limited to, images, text, descriptions and site design, is the exclusive property of L.G. GEMME and is protected by Italian and European copyright and intellectual property laws. Unauthorized reproduction, distribution, publication or use of any material is prohibited without the express consent of L.G. GEMME. Any violation will be legally prosecuted.

 

 

  1. Return Policy and Right of Withdrawal

 

  1. Right of Withdrawal

In accordance with the provisions of the Italian Consumer Code (Legislative Decree 206/2005), the customer has the right to withdraw from the contract within 14 days from the date of receipt of the product, without having to provide any reason. However, this right does not apply to customized products, created at the specific request of the customer. By placing an order for a customized product, the customer implicitly waives the right of withdrawal.

 

Items considered “rare stones” and easily damaged are also excluded from the right of withdrawal. Eventually such items will be carefully inspected upon return for damage. In case of discrepancies from the original condition, L.G. GEMME reserves the right to refuse the return.

  1. Refund Terms

The refund will be made within 15 working days of receiving the returned product and after the appropriate checks. The shipping costs, both initial and related to the return, will be entirely borne by the customer.

If the product has minor damage (such as small scratches), L.G. GEMME reserves the right to apply a deduction on the refund, corresponding to the cost necessary to restore the item and the depreciation resulting from the processing that could reduce the weight and size of the product. It is specified, however, that in some cases the damage suffered by the product could be irreparable, and the seller will not be able to proceed with the restoration, which will result in the refusal of the return.

To be able to benefit from the right of withdrawal, the product must be returned in the original packaging, without signs of use, damage or modifications. Any customized or commissioned products cannot be returned, unless otherwise agreed with L.G. GEMME.

Shipments to Italy are made within 1-3 working days.

For shipments to Europe, delivery times are 2-6 working days.

For international shipments outside of Europe, delivery times will be communicated by email at the time of ordering.

An express shipping option is available on request for Italy, with delivery in 1-2 working days, at an additional cost that will be specified at the time of ordering.

The delivery times indicated are estimates and may vary based on external factors such as holidays, high traffic or courier delays. We will do our best to update the customer in case of significant delays.

  1. Customs duties and force majeure

Customs duties and import taxes

L.G. GEMME is not responsible for any customs duties, taxes or other additional costs imposed by the destination countries. These costs are the responsibility of the customer and must be paid at the time of delivery or earlier, if required by the customs authorities of the destination country. Any delays caused by customs detentions are not attributable to L.G. GEMME.

Force majeure

L.G. GEMME cannot be held responsible for delays in delivery or failure to deliver due to events of force majeure, including but not limited to natural disasters, war, insurrection, pandemics, government restrictions, strikes, difficulties in transportation or other circumstances beyond our control. In such cases, we will do our best to inform the customer promptly, but any delays or inconveniences will not give right to any compensation.

The rare gems sold by L.G. GEMME are not subject to the 24-month legal guarantee of conformity provided by European legislation, as they are unique and non-replicable products. However, we guarantee that the products comply with the description provided at the time of purchase and are free from obvious defects at the time of delivery. In any case, L.G. GEMME undertakes to provide after-sales assistance for any problem encountered, evaluating each request on a case-by-case basis, in order to guarantee maximum customer satisfaction.

 

  1. Conditions for the Guarantee

The guarantee covers exclusively manufacturing or conformity defects that are immediate and detectable at the time of delivery of the product. The following cases are not covered by the guarantee:

- Damage caused by improper use of the product.

- Damage due to accidents or unauthorized modifications.

- Normal wear and tear of the product over time.

- Damage generated by the customer during use of the product.
